1. Acceptance of Terms

By downloading, installing, accessing, or using the Meal Chef AI mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Gwinyai Nyatsoka ("we," "our," or "us"), the developer and operator of Meal Chef AI.

2. Description of Service

Meal Chef AI is an AI-powered mobile application that provides personalized meal planning, recipe suggestions, nutritional guidance, and related services. The App uses artificial intelligence to generate customized meal plans based on your health profile, dietary preferences, and fitness goals.

Key Features Include:

• AI-generated personalized meal plans
• Recipe creation and suggestions based on preferences and available ingredients
• Calorie and goal tracking with AI-powered insights
• Personal cookbook for saving and sharing recipes
• Food photography analysis and meal suggestions
• Integration with Apple Health (with permission)

3. Account Requirements and Eligibility

• You must be at least 13 years old to use the App
• Users under 18 must have parental consent
• Account creation requires Google Sign-In or Apple Sign-In
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account
• You agree to notify us immediately of any unauthorized use of your account

4. Fair Usage Policy

Usage Limitations:

• Daily usage limits apply to AI-powered features including meal plan generation, recipe creation, and food analysis
• Usage limits are calculated based on computational resources consumed by AI processing
• Your current usage status is visible in the "Fair Usage" section within App Settings
• Usage limits reset daily at 12:00 AM UTC
• Exceeding daily limits may temporarily restrict access to AI features until the next reset
• Premium subscribers may have higher usage allowances

Prohibited Usage:

• Attempting to circumvent or bypass usage limitations
• Using automated tools, scripts, or bots to access the App
• Making excessive requests designed to overwhelm our systems
• Sharing account credentials to avoid individual usage limits
• Commercial use of AI-generated content without proper licensing

5. Medical and Nutritional Disclaimers

Health and Safety:

• Always consult with qualified healthcare professionals before making significant dietary changes
• The App's recommendations are based on general nutritional guidelines and AI algorithms, not personalized medical advice
• We do not guarantee the accuracy of caloric calculations, nutritional information, or health recommendations
• Users with medical conditions, allergies, or dietary restrictions should verify all recommendations with healthcare providers
• The App is not intended to diagnose, treat, cure, or prevent any disease
• Pregnant or nursing women should consult healthcare providers before using meal plans

User Responsibility:

• You are solely responsible for evaluating the suitability of meal plans and recipes
• You assume all risks associated with following AI-generated meal plans
• You must verify ingredient safety and check for allergens before consuming any recommended foods
• Stop using the App and consult a healthcare provider if you experience any adverse effects

6. Intellectual Property Rights

Our Rights:

• The App, including its design, code, algorithms, and AI models, is protected by intellectual property laws
• All trademarks, service marks, and logos are owned by us or our licensors
• You may not copy, modify, distribute, sell, or lease any part of the App
• Reverse engineering, decompiling, or attempting to extract source code is prohibited

Your Content:

• You retain ownership of photos, recipes, and other content you create or upload
• By using the App, you grant us a license to process your content to provide services
• You represent that you have the right to upload and share any content you submit
• We may remove content that violates these Terms or applicable laws

7. Prohibited Conduct and Account Suspension

Prohibited Activities:

• Illegal Use: Using the App for any illegal purpose or in violation of local, state, national, or international laws
• Harmful Content: Uploading or sharing content that is offensive, harmful, threatening, abusive, or discriminatory
• System Abuse: Attempting to hack, disrupt, or damage the App's infrastructure or security
• Spam and Fraud: Creating fake accounts, spreading spam, or engaging in fraudulent activities
• Commercial Misuse: Using the App for unauthorized commercial purposes or reselling AI-generated content
• Impersonation: Pretending to be another person or entity
• Privacy Violations: Attempting to access other users' private information
• Intellectual Property Infringement: Uploading content that violates others' copyrights, trademarks, or patents

Enforcement Actions:

• Warning: First-time minor violations may result in a warning
• Temporary Suspension: Serious or repeated violations may result in temporary account suspension (1-30 days)
• Permanent Termination: Severe violations or repeated offenses may result in permanent account termination
• Legal Action: We reserve the right to pursue legal action for illegal activities
• Data Preservation: We may preserve account data for legal compliance even after termination

Appeals Process:

• You may appeal account actions by contacting support at gnyatsoka@gmail.com
• Include your account email and detailed explanation of the circumstances
• Appeals are reviewed within 5 business days
• Our decision on appeals is final

8. Subscription and Payment Terms

• Subscription fees are processed through the Apple App Store
• Prices are subject to change with notice
• Subscriptions automatically renew unless cancelled
• Refunds are governed by Apple's refund policy
• We do not store or process payment information directly
• Premium features are only available to active subscribers

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We implement industry-standard security measures
• You can request data deletion at any time
• We comply with applicable data protection laws (GDPR, CCPA, PIPEDA)

10. Limitation of Liability

Disclaimer of Warranties:

• The App is provided "as is" without warranties of any kind
• We do not warrant that the App will be error-free or uninterrupted
• We do not guarantee the accuracy of nutritional information or AI recommendations
• We disclaim all warranties, express or implied, including merchantability and fitness for purpose

Limitation of Damages:

• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages
• We are not responsible for damages arising from your use of meal plans or recipes
• We are not liable for health issues, allergic reactions, or dietary complications

11. Indemnification

You agree to indemnify, defend, and hold harmless Gwinyai Nyatsoka and the Meal Chef AI service from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload or share through the App
• Any health issues arising from following meal plans or recipes

12. Governing Law and Dispute Resolution

• These Terms are governed by the laws of Zimbabwe
• Any disputes shall be subject to the exclusive jurisdiction of Zimbabwe courts
• We encourage resolving disputes through direct communication first
• If legal action becomes necessary, the prevailing party may recover reasonable attorneys' fees

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify users through in-app notifications
• Include information about changes in App Store update notes
• Provide at least 30 days' notice for material changes

Your continued use of the App after changes take effect constitutes acceptance of the new Terms.

14. Termination

Your Right to Terminate:

• You may terminate your account at any time through the App settings
• You may also request account deletion by emailing gnyatsoka@gmail.com
• Termination does not automatically cancel App Store subscriptions

Our Right to Terminate:

• We may suspend or terminate your account for violations of these Terms
• We may discontinue the App with 60 days' notice
• Termination may be immediate for serious violations or legal requirements

Effect of Termination:

• Your right to use the App immediately ceases
• Your data will be deleted according to our Privacy Policy
• Sections of these Terms that should survive termination will remain in effect

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Meal Chef AI regarding the use of the App. These Terms supersede any prior agreements or understandings.
